This Policy applies to information we collect through our website, forms, communications, and in the course of delivering our services. When we process Protected Health Information (PHI) on behalf of healthcare clients, we do so under Business Associate Agreements (BAAs) and in accordance with HIPAA and applicable law. Where a client is subject to 42 CFR Part 2, we contract accordingly.
Depending on jurisdiction, our processing may rely on legitimate interests, contract necessity, consent (for certain marketing and analytics), compliance with law, and — in clinical contexts — HIPAA-governed Business Associate Agreements.
We do not sell personal information.
We apply administrative, technical and physical safeguards appropriate to the sensitivity of the data, including access controls, encryption in transit, least-privilege practices, logging and monitoring, and privacy and security training. No method of transmission or storage is 100% secure. Our specific safeguards are described in our Security Statement.
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes and enforce agreements. Client records and PHI retention are governed by contract, BAA and applicable law.
Patients of our healthcare clients should direct requests about their health records to the practice itself. As a business associate, we act on the covered entity’s instructions.
If we transfer personal information across borders, we use appropriate safeguards consistent with applicable data-protection law.
Our website is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
Our site may link to third-party websites or services. Their privacy practices are governed by their own policies.
We may update this Policy from time to time. The “Last updated” date at the top of this page reflects the most recent changes.

These Terms of Service govern your use of Texoft’s website and services. Please read them carefully.
By accessing or using the Texoft website or services (collectively, the “Services”), you agree to be bound by these Terms of Service. If you do not agree, do not use our Services.
Texoft provides healthcare technology services including, but not limited to, managed IT and network security, HIPAA Security Risk Assessments, compliance programs and training, cloud migration, AI and workflow automation, physical security and building automation, and digital marketing and revenue cycle services. Specific services are detailed in a separate Service Agreement.
To access certain Services you may need an account. You agree to provide accurate registration information, maintain the security of your credentials, notify us immediately of any unauthorized use, and accept responsibility for activity under your account.
Healthcare compliance: as a provider of healthcare technology services, Texoft complies with applicable healthcare regulations including HIPAA. Our Business Associate Agreement sets out our specific obligations regarding PHI.
All content on our website and provided through our Services — text, graphics, logos, policy templates, training materials and software — is the property of Texoft or its licensors and is protected by intellectual property law. You are granted a limited, non-exclusive, non-transferable license to access and use our Services for your internal business purposes.
Fees are specified in your Service Agreement and payment is due according to its terms. Late payments may be subject to interest charges, and we reserve the right to suspend services for non-payment.
Both parties agree to maintain the confidentiality of proprietary or confidential information received from the other. This obligation survives termination of these Terms.
To the maximum extent permitted by law, Texoft shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses resulting from your access to or use of (or inability to use) the Services, the conduct or content of any third party on the Services, or unauthorized access to or alteration of your transmissions or content.
We may terminate or suspend access to our Services immediately, without prior notice or liability, for any reason, including breach of these Terms.
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law provisions.
We may modify or replace these Terms at any time and will provide notice of material changes through our website. Continued use of the Services after changes constitutes acceptance.
